Spire Learning Terms and Conditions

 

1.        Introduction

These Terms and Conditions govern the provision of tutoring services by Spire Learning ("the Tutor", "we", "us", "our") to students and their parents or legal guardians ("the Client").

By booking tutoring sessions with Spire Learning, the Client agrees to be bound by these Terms and Conditions.

2.        Tutoring Services

Spire Learning provides educational tutoring and academic support to children and young people.

Tutoring may take place:

  • Face-to-face at an agreed location;

  • Online using an agreed video conferencing platform; or

  • Through a combination of both.

The Tutor will use reasonable skill and care in planning and delivering lessons. However, no guarantee can be given regarding examination results, school placements, grades, academic progress, or other outcomes.

3. Bookings and Lesson Arrangements

Lessons will be arranged by mutual agreement between the Tutor and the Client.

Any changes to regular lesson arrangements should be requested as early as possible.

The Tutor reserves the right to decline bookings or discontinue tuition where this is considered appropriate.

4. Fees

Tuition fees will be charged at the rate agreed with the Client.

Any increase in fees will be communicated with at least 30 days' notice.

Additional charges may apply for:

  • Travel to locations outside the Tutor's usual operating area;

  • Specialist resources requested by the Client;

  • Extended sessions beyond the agreed duration.

5. Payment

Payment is due within 24 hours of the lesson unless otherwise agreed in writing.

Payments should be made by bank transfer or another agreed payment method.

The Tutor reserves the right to suspend future lessons where payment remains outstanding.

Any costs incurred in recovering unpaid fees may be added to the amount owed where legally permissible.

6. Cancellation Policy

Cancellation by the Client

At least 24 hours' notice must be given to cancel or reschedule a lesson.

Lessons cancelled with less than 24 hours' notice will normally be charged in full.

Failure to attend a scheduled lesson without notice will be charged at the full lesson fee.

Cancellation by the Tutor

If the Tutor needs to cancel a lesson (eg. due to illness or unforeseen circumstances), reasonable notice will be given wherever possible.

The Tutor will offer:

  • A rescheduled lesson at a mutually convenient time; or

  • A refund for the cancelled lesson.

 

7. Illness

The Client should not send a student to a face-to-face lesson if the student is unwell with a contagious illness.

Where possible, lessons may be transferred online instead.

The Tutor reserves the right to decline a face-to-face lesson if there are concerns regarding illness or safety.

8. Online Tuition

For online lessons, the Client is responsible for ensuring:

  • A suitable device is available;

  • A stable internet connection is available;

  • The student has a quiet learning environment.

The Tutor is not responsible for lesson disruption caused by technical issues beyond their reasonable control.

Lessons must not be recorded, shared, streamed, or distributed without the prior written consent of the Tutor.

9. Parent and Student Responsibilities

The Client agrees to:

  • Ensure the student attends lessons punctually;

  • Provide accurate information relevant to the student's educational needs;

  • Maintain respectful communication with the Tutor;

  • Provide a safe and suitable environment for face-to-face lessons.

Students are expected to behave respectfully throughout lessons.

The Tutor may terminate a lesson if behaviour is disruptive, threatening, abusive, or prevents effective teaching.

Where a lesson is terminated for behavioural reasons, the full lesson fee may still be payable.

10. Safeguarding

Spire Learning is committed to safeguarding children and promoting their welfare.

The Tutor will take reasonable steps to maintain a safe learning environment and comply with relevant safeguarding obligations.

Parents and guardians remain responsible for the welfare and supervision of their child outside lesson times.

Where the Tutor becomes aware of information suggesting a child may be at risk of harm, the Tutor may share relevant information with appropriate authorities in accordance with safeguarding obligations.

12. Educational Resources

The Tutor may provide worksheets, notes, lesson materials, and other resources.

All materials remain the intellectual property of Spire Learning unless otherwise stated.

Materials are supplied solely for the student's personal educational use and may not be reproduced, distributed, sold, or published without permission.

13. Data Protection and Privacy

Spire Learning will process personal information only as necessary to:

  • Provide tutoring services;

  • Communicate with clients;

  • Maintain records;

  • Comply with legal obligations.

Personal information will be handled in accordance with applicable UK data protection legislation.

14. Limitation of Liability

Nothing in these Terms and Conditions excludes or limits liability where such limitation would be unlawful.

Subject to the above:

  • The Tutor shall not be liable for indirect or consequential losses;

  • The Tutor shall not be responsible for examination outcomes, school admissions decisions, or academic performance;

  • The Tutor's total liability shall not exceed the fees paid by the Client for tutoring services during the preceding 12 months.

16. Termination

Either party may terminate tutoring arrangements by giving 7 days' written notice.

Outstanding fees remain payable following termination.

The Tutor may terminate services immediately where:

  • Fees remain unpaid;

  • There is abusive or inappropriate conduct;

  • Safeguarding concerns arise;

  • Continuing tuition is no longer practical or appropriate.

17. Changes to These Terms

Spire Learning reserves the right to update these Terms and Conditions from time to time.

Clients will be notified of any material changes.
